These are the terms and conditions for:

(Hereinafter referred to as “Sark Labs”).

The following terms and conditions apply to the website, products and services offered by Sark Labs. This includes the mobile and tablet versions as well as any other version of Sark Labs accessible via desktop, mobile, tablet, social media or other devices.

By using the website and purchasing the products/services/trainings/courses, you agree to be bound by these terms and conditions and our privacy policy. In these terms and conditions, the words “website” refer to the website, “we”, “us”, “our” and “Sark Labs” refer to Sark Labs LLC and “you” and “user” refer to you, the user of Sark Labs.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING, USING OR OBTAINING ANY MATERIALS, INFORMATION OR PRODUCTS.

  1. ELIGIBILITY

Use of the website and purchase of products may only be made in accordance with these terms and conditions and all applicable local, national and international laws, rules and regulations.

Access to the website and the products available on the website are available to all ages, although we do not collect personal information from persons under the age of 13 (see privacy policy). It is the responsibility of parents or legal guardians to determine whether any of the content, services and products are appropriate for their children or minors under their guardianship.

By using the website and purchasing the products, you represent and warrant that you have full right, power and authority to enter into these terms and conditions and to fully perform all of your obligations hereunder. You further represent and warrant that you have no legal incapacity or contractual restriction that would prevent you from agreeing to these terms and conditions.

You represent and warrant that your use of the website does not violate any applicable law or regulation. Sark Labs may, in its sole discretion, refuse to offer the website and products to any user and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the website is revoked in such jurisdictions.

  1. ACCOUNT

If you register on Sark Labs, you will be required to choose a password, and you may be asked for additional information regarding your account. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. The password and access to the account and related products/services/trainings/courses is non-transferable. You may not share your password or user account with another user or student. Sharing the password and user account with another user or student may result in the termination of the user’s or student’s account without any refund.

You agree to immediately notify Sark Labs of any unauthorized use of your password or account or any other breach of security, and to ensure that you log out of your account at the end of each session. You may never use another user’s account without Sark Labs’ prior authorization. Sark Labs will not be liable for any loss or damage arising from your breach of this agreement.

By providing Sark Labs with your email address & phone number, you agree that we may use these contact details to send you notifications about the status of your order, important communications about our services or products, news and special content. We may also use your contact details to send you notifications, such as changes to service features and special offers on our products and services. If you do not wish to receive these emails, you may opt-out of receiving them by sending us your request through our contact information or by using the “unsubscribe” option in the emails. Opting out may prevent you from receiving emails about updates to your order, news or special offers on our products and services.

Users may cancel their accounts at any time and for any reason by sending us their request through our contact information. Such cancellation will only result in the deletion of the account and the deletion of all personal data granted to Sark Labs.

Sark Labs reserves the right to terminate your account or your access immediately, with or without notice to you, and without liability to you, if Sark Labs believes that you have breached any of these terms, furnished Sark Labs with false or misleading information, or interfered with use of the website or the service by others.

  1. PRODUCTS – SERVICE/TRAINING/COURSE/WEBINAR/ETC.

By placing an order for a product – service/training/course/webinar/etc. through the website, you are offering to purchase it for the price advertised and indicated on the website at the time you purchase the product. Please check the description of the content and features before placing the order. Once the payment process is completed, Sark Labs will send the user the login information and all the necessary information to access the purchased item.

When a user purchases a product, Sark Labs will send an email to the user to confirm the purchase and payment of the course. This confirmation email will contain the access information for the corresponding product.

Access to the product will be available on 1 device per user. In the event that the user wishes to access the course through another device, the user must submit a specific request through our contact information.

Sark Labs may cancel any order and may change or discontinue the availability of the products at any time at its sole discretion. If an order is cancelled, any payment made will be refunded in full. This does not affect your statutory rights.

All new orders are considered separately and each is treated individually.

  1. PRICES

Sark Labs reserves the right to determine product- service/training/course/webinar/etc. pricing. The prices may be subject to change at any time without notice.

Sark Labs will use reasonable efforts to keep pricing information posted on the website up to date. We encourage you to periodically check our website for updated pricing information for our products/services/trainings/courses.

We will always attempt to keep the prices on the website accurate. However, from time to time pricing errors may occur, including but not limited to human, mechanical or similar errors. If a pricing error is discovered, the customer will be informed of the error. User will have the option to reconfirm the order at the correct price. The user also has the option to cancel the order if not satisfied with the correct price.

  1. PAYMENTS

Products – services/trainings/courses/webinars/etc. can be paid through PayPal, Stripe, Razorpay or other payment processors available on the website. They can also be paid through cryptocurrencies if the option is made available. The charge will be made to the credit/debit card or the PayPal account balance will be debited immediately after completing the payment process for the corresponding product. In the case of payment through cryptocurrencies, the payment will be debited from the buyer’s virtual wallet. Once the transaction is processed, we will send you an electronic receipt of the transaction to the email address you provide during the purchase or registration process.

If you find any inconsistency in your billing, please contact us through our contact information or you can make the claim through the customer service of the corresponding payment platform.

If your card is declined, you will receive an error message. No payment will be charged to your card and no order will be processed. There may be a pending transaction on your account until your card issuing bank withdraws the authorization. This usually takes 2 to 5 business days. Your card may be declined for various reasons such as insufficient funds, AVS (Address Verification System) mismatch or you have entered an incorrect security code.

If your payment is declined, you must provide an alternative payment method or provide another card where payment can be charged and processed.

Your payment information will be treated and safeguarded with total security and with the exclusive purpose of processing the purchase of the products. Sark Labs reserves the right to contract any payment platform available in the market, which treats your data for the exclusive purpose of processing the purchase of the products.

  1. DISCLAIMER

By accessing the website and purchasing the products, the user accepts personal responsibility for the results of using the information available in the course content. User agrees and represents that Sark Labs does NOT guarantee any benefit, nor any type of positive or negative result from the use of the information users obtain through the courses. User also agrees that Sark Labs does not guarantee any type of result from the use of the information and content available on the website in general. Sark Labs provides resources and content for informational and educational purposes only. You acknowledge that your ultimate success or failure will be the result of your own efforts, your particular situation and a variety of other circumstances beyond Sark Labs’ control. Your use or misuse of any content or information obtained through the courses is at your own risk and responsibility. Sark Labs does not accept any claims for the use or misuse of information obtained through the courses by users.

Liability Limitation

Sark Labs provides all products and services, including webinars, coaching programs, digital downloads, and consulting services, for educational and informational purposes only. While we strive to provide the highest quality content, Sark Labs cannot guarantee specific results or outcomes from the use of our services or products.

No Guarantees:

Sark Labs makes no guarantees, express or implied, regarding the effectiveness or outcomes of any product or service provided. The success of our coaching programs depends on individual effort, commitment, and application of the material. But, we are committed to provide the users with the best possible assistance to achieve their goals, even after the refund windows has expired.

Limitation of Liability:

Sark Labs shall not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use or inability to use our products or services, even if Sark Labs has been advised of the possibility of such damages. This limitation applies to any claims arising from negligence, breach of contract, or other legal theories.

Educational Purposes Only:

All content, advice, and materials provided by Sark Labs are intended for educational purposes only and should not be construed as professional, financial, or legal advice.

  1. COPYRIGHT

The content and copyrights of the products are the exclusive property of Sark Labs. Sark Labs owns all text, images, music, videos, worksheets, blog posts, reports, trademarks and other materials contained in the courses and on the website. No content available on the trainings/courses and website may be duplicated, distributed or used for unauthorized purposes without the express written consent of Sark Labs. Any unauthorized use of the content available in the trainings/courses may result in claims and lawsuits for infringement of Sark Labs’ copyrights.

All materials on Sark Labs, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Sark Labs or by third parties that have licensed or otherwise provided their material to the website. You acknowledge and agree that all Materials on Sark Labs are made available for limited, non-commercial, personal use only. Except as specifically provided herein. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without Sark Labs prior express written permission. You may not add, delete, distort, or otherwise modify the material. Any unauthorized attempt to modify any material, to defeat or circumvent any security features, or to utilize Sark Labs or any part of the material for any purpose other than its intended purposes is strictly prohibited. Please do not copy any content and pass it off as your own, as a copyright infringement will occur.

  1. COPYRIGHT INFRINGEMENT

Sark Labs will respond to all inquiries, complaints and claims related to alleged infringement by breach or violation of the provisions contained in international copyright and intellectual property laws and regulations. Sark Labs respects the intellectual property of others and expects users to do the same. If you believe, in good faith, that any material provided on the Sark Labs website infringes your copyright or other intellectual property rights, please submit your request via our contact information, with the following information:

Intellectual Property Rights

All content provided by Sark Labs, including but not limited to digital downloads, webinars, coaching materials, and consulting documents, is protected by copyright laws. By purchasing or accessing any Sark Labs content, you are granted a non-exclusive, non-transferable license to use the content for personal, non-commercial purposes.

License to Use:

Customers are purchasing a license to use the content, not ownership of the content itself. You may not reproduce, distribute, modify, or create derivative works from the content without prior written permission from Sark Labs.

Prohibited Actions:

Reselling, sharing, or distributing Sark Labs content in any form, whether for free or for a fee, is strictly prohibited.

Any unauthorized use of our content will result in the immediate termination of your license and may result in legal action.

Ownership:

Sark Labs retains full ownership of all intellectual property rights related to the content, including all copyrights, trademarks, and proprietary rights.

  1. REFERRAL PROGRAM

The users will be able to register in our program of referrals and to gain commissions for the sales realized across the link of affiliate provided by Sark Labs. For each purchase of our products – services/trainings/courses/webinars/etc. made on the website through the affiliate link, the affiliate user will receive a percentage as commission. The commissions for the sales realized across the links of affiliation will be credited in the account of the user. Users will be able to withdraw commissions through our payment processors available on the website. Affiliate links are unique and non-transferable.

  1. ADVERTISING

Through the website, Sark Labs may make available to users, commercial and advertising information, own or third parties in accordance with good business practices. In these cases, Sark Labs does not endorse, guarantee or commit its responsibility for the services and/or products marketed by these third parties, since the website serves as a communication and advertising channel, but not as a tool for the provision of services. Consequently, it is the full responsibility of the users to access the sites that send advertising, assuming the obligation to verify and know the conditions of the services offered by third parties.

  1. PROHIBITED ACTIVITIES

The content and information available on the website (including, but not limited to, data, information, text, music, sound, photos, graphics, video, maps, icons, or other material), as well as the infrastructure used to provide such content and information, are owned by or licensed to Sark Labs by third parties. Such third parties may charge a fee for use of certain content or services provided on or by way of their websites. Therefore, you should make whatever investigation you feel is necessary or appropriate before proceeding with any transaction with any third party to determine whether a charge will be incurred. Where Sark Labs provide details of fees or charges for such third-party content or services, such information is provided for convenience and information purposes only. Any interactions with third party sites and apps are at your own risk. You expressly acknowledge and agree that Sark Labs are in no way responsible or liable for any such third-party sites.

  1. INDEMNIFICATION

You agree to defend and indemnify Sark Labs and any of their directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

  • Your breach of this agreement or the documents referenced herein.
  • Your violation of any law or the rights of a third party.
  • Your purchase of products – services/trainings/courses/webinars/etc.
  1. ELECTRONIC COMMUNICATIONS

No responsibility will be accepted by Sark Labs for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorized human act, including any errors or mistakes.

  1. CHANGES AND TERMINATION

We may change the website and these terms at any time, in our sole discretion and without notice to you. You are responsible for remaining knowledgeable about these terms. Your continued use of the website constitutes your acceptance of any changes to these terms and any changes will supersede all previous versions of the terms. Unless otherwise specified herein, all changes to these terms apply to all users take effect. Furthermore, we may terminate this agreement with you under these terms at any time by notifying you in writing (including by email) or without any warning.

  1. PERSONAL DATA

Any personal information you provide or submit in connection with the purchase of products/services/trainings/courses will be used in accordance with our privacy policy. Please refer to our privacy policy.

  1. INTEGRATION CLAUSE

This agreement together with the privacy policy and any other legal notices published by Sark Labs, shall constitute the entire agreement between you and Sark Labs concerning and governs your use of the website.

  1. DISPUTES

You agree that any dispute, claim or controversy arising out of or relating to these terms and conditions, or the breach, termination, enforcement, interpretation or validity thereof or the use of the services, shall be resolved by binding arbitration between you and Sark Labs, provided that each party retains the right to bring an individual action in a court of competent jurisdiction.

In the event a dispute arises in connection with your use of the website, purchase of the products or breach of these terms, the parties agree to submit their dispute to arbitration resolution before a reputable arbitration organization, as mutually agreed by the parties and in accordance with applicable commercial arbitration rules.

You agree to initiate a formal dispute proceeding by sending us a communication through our contact information. Sark Labs may choose to send you a written offer after receiving your initial communication. If we offer and send you a settlement offer and you do not accept the offer, or we are unable to resolve your dispute satisfactorily and you wish to continue with the dispute process, you must initiate the dispute resolution process before an accredited arbitration organization and file a separate Demand for Arbitration. Any award rendered by the arbitration tribunal shall be final and conclusive on the parties.

To the fullest extent permitted by law, you agree that you will not file, join or participate in any class action lawsuit in connection with any claim, dispute or controversy that may arise in connection with your use of the website, purchase of the products.

The courts of India shall have jurisdiction over any dispute, controversy or claim relating to Sark Labs and its business operations. Any such dispute or controversy shall be brought and resolved in the courts of Pune, India.

  1. REFUNDS

Webinars:

Refunds for webinars are not allowed. If you miss the webinar, you will be allowed to attend the webinar at a later date but refunds wont be provided. If the webinar is cancelled by Sark Labs, you will be offered the option to receive a full refund in case of cancellation. If the webinar is rescheduled by Sark Labs, you will be offered the option to transfer your registration to the rescheduled date. Sark Labs reserves the rights to change the dates of the webinars or reschedule the webinars due to unavoidable reasons.

Digital Downloads & Subscription Products:

Due to the nature of digital products, all sales of digital downloads are final and non-refundable. Please ensure you review the product description carefully before purchase. In case of technical issues with the download, please contact our support team within 7 days of purchase for assistance.

Coaching Program (For Program tenures more than 7 days):

For long duration coaching programs (typically 7 days or longer in tenure), the refund requests should be submitted within the refund deadline. The refund deadline for all coaching program is 100 Days. Meaning, refund request must be submitted before 100 days from the purchase of the coaching program.

The Coaching sessions can be rescheduled or cancelled by Sark labs. You will be provided with a new date in case of such an event. If you miss the coaching session, users will be provided with a repeat session of a future date or recordings whichever is beneficial. Rescheduling of coaching sessions will be considered on a case by case basis.

Consulting Services:

All sales of consulting services are final and non-refundable. Consulting services are billed according to the agreed-upon contract. Cancellations or changes must be made at least 48 hours in advance.

Exceptions:

No refunds will be issued for products or services that have already been delivered or consumed. Special conditions or exceptions may apply, as outlined in the specific product or service terms. The satisfaction of our users with our products is important to us. If after completing all the necessary steps you have not achieved results you can contact us and we will do everything necessary for you to meet your goals with use of your products successfully. If for any reason we are unable to help you and you have shown us that you have completed all the necessary steps to complete the course/training/webinar/etc., we will issue you a refund with mutual discussion and agreement.

All Refund requests for PRODUCTS mentioned above must meet the following requirements:

  • Refund requests must be submitted within the refund deadline from the date of product purchase.
  • Refund requests will be handled on a case-by-case basis.
  • The user must demonstrate that the user made the necessary efforts to complete the course. If the user did not complete the training/tasks/worksheets/tasks/fun activities or did not implement the strategies taught in the products, the refund will be denied.
  • If the user downloads the course material or content and immediately makes the request for a refund, the refund will be denied.
  • In the event that the user requests a refund but does not provide proof of completing the assignments/worksheets/applications contained in the product and the refund is denied, the user or student will continue to receive support from Sark Labs in the purpose of successfully completing the product purchased action items.
  • In the case of payment through PayPal, this policy does not cover PayPal’s warranty policy, in the case of requesting a refund through PayPal, your refund request will be denied under the terms of this policy.
  • In the event that the refund request is denied for any of the above reasons and the user makes the refund request through PayPal, the refund request in PayPal will also be denied for the same reasons.
  1. REFUND PROCESSING

Once your refund request has been received and approved, please allow 3 to 5 business days for the request to be processed and resolved. The refund request will be answered negatively or positively. In the event that the refund request is approved, the refund will be processed and issued via the original payment method. If after 5 business days you have not received your refund, please contact us through our contact information.

  1. PAYMENT TERMS

Accepted Payment Methods:

Sark Labs accepts various payment methods, including major credit cards, debit cards, and online payment gateways such as Razorpay. All payments must be made in the currency specified at the time of purchase.

Recurring Payments:

For subscription-based services or recurring payments, the payment will be automatically charged to your selected payment method at the agreed-upon intervals. You will be notified before any renewal charges are processed, and you may cancel your subscription at any time by contacting our support team.

Failed Payments:

In the event of a failed payment, you will be notified, and we will attempt to process the payment again. If the payment fails multiple times, your access to the product or service may be suspended until payment is successfully processed.

Taxes and Additional Charges:

Prices listed for products and services may be subject to applicable taxes based on your location. Any additional charges or fees, such as currency conversion fees, will be your responsibility.

Invoicing:

If applicable, invoices for services will be issued according to the terms agreed upon during the purchase process. Payment is due upon receipt of the invoice unless otherwise specified.

22. SERVICE SPECIFIC TERMS

Webinars:

Sark Labs offers educational webinars designed to enhance your cognitive skills, memory, reading speed, etc. By registering for a webinar, you agree to participate actively and adhere to the guidelines provided during the session. Access to recorded sessions wont be provided for webinars. But users may be given an option to attend the webinars again for a future date if agreed by Sark Labs.

Coaching Sessions:

Our coaching services are personalized sessions aimed at improving your brain performance and cognitive abilities. Each session is tailored to your individual needs. Clients can expect to receive actionable insights and strategies to enhance their learning and memory. Specific goals and outcomes will be discussed and agreed upon during the initial consultation.

Consulting Services:

Consulting services provided by Sark Labs include professional advice and strategies related to cognitive enhancement, speed reading, and memory improvement. These services are customized based on the client’s needs and may involve multiple sessions or ongoing support. Clients will receive a action plan after the session.

23. SERVICE DELIVERY

Sark Labs delivers its services through a combination of online platforms and in-person sessions if agreed, depending on the nature of the service and client preferences.

Online Platforms:

Webinars, coaching, and consulting sessions are typically conducted through online platforms such as Zoom, Zoho, Microsoft Teams, or similar services. Clients are responsible for ensuring they have the necessary technology and internet connectivity to participate in these sessions.

Technical Issues:

In the event of technical issues that prevent the successful delivery of a session, Sark Labs will work with the client to reschedule the session at no additional cost. Clients are encouraged to test their equipment prior to the session to avoid disruptions.

In-Person Sessions:

In-person sessions are available upon request and will be conducted at a mutually agreed location. Any travel or accommodation expenses incurred for in-person sessions will be discussed and agreed upon with the client in advance.

24. CODE OF CONDUCT

At Sark Labs, we are committed to providing a positive, respectful, and productive environment for all participants during our webinars, coaching sessions, and consulting services. To ensure this, we have established the following code of conduct that all participants must adhere to:

1. Respectful Behavior:

All participants are expected to treat each other with respect and courtesy. Discriminatory, harassing, or offensive language or behavior will not be tolerated.

2. No Disruptions:

Disruptive behavior, including but not limited to interrupting the facilitator or other participants, unauthorized sharing of content, or attempting to derail the session, is prohibited.

3. Confidentiality:

Participants must respect the confidentiality of others. Sharing personal information or sensitive content discussed during sessions outside of the session is strictly prohibited.

4. Intellectual Property:

Unauthorized recording, copying, or distribution of session content is prohibited. All content provided during sessions is the intellectual property of Sark Labs.

5. Consequences of Misconduct:

Sark Labs reserves the right to remove any participant from a session who violates this code of conduct. Participants removed for misconduct will not be eligible for a refund, and their access to future sessions may be restricted.

6. Reporting Violations:

If you experience or witness any behavior that violates this code of conduct, please report it to [contact information] immediately. We take all reports seriously and will take appropriate action to address the situation.

7. Cross-Communication Policy

Participants are encouraged to engage in discussions relevant to the session topics. However, any communication between participants must remain professional and respectful. Unauthorized solicitation, marketing, or promoting external products/services to other participants during sessions is not allowed.

Sark Labs is not responsible for any agreements or exchanges made between participants outside of our sessions. We advise participants to exercise caution when engaging in any outside communications.

8. Sharing Services

The services and content provided by Sark Labs are intended for individual use only. Sharing access to webinars, coaching sessions, or digital downloads with others who have not purchased the service is strictly prohibited.

If Sark Labs determines that services are being shared in violation of this policy, the involved participants may have their access revoked without a refund, and they may be barred from future services.

25. FINAL PROVISIONS

These terms and conditions are governed by the laws of India. Use of our website and purchase of our products and services on the website is not authorized in any jurisdiction that does not give effect to all of the provisions of these terms.

Our performance of these terms is subject to existing laws and legal process, and nothing contained in these terms limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of our website or information provided to or gathered by us with respect to such use.

If any part of these terms is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired. Our failure or delay in enforcing any provision of these terms at any time does not waive our right to enforce the same or any other provision(s) hereof in the future.
